These Terms of Service ("Terms") govern your use of the Reviewbird platform ("Service") operated by Clif Griffin Development Inc, doing business as Reviewbird ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or installing our application, you agree to these Terms. If you do not agree, you may not use the Service.
2. Service Description
Reviewbird is a review management platform that helps e-commerce merchants collect, manage, and display customer reviews. Our Service includes:
- Automated review request emails
- Review collection and moderation tools
- Review display widgets for your storefront
- Review import and export capabilities
- Analytics and reporting
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. User Responsibilities
When using our Service, you agree to:
- Comply with all applicable laws and regulations, including consumer protection and data privacy laws
- Not use the Service to send unsolicited or misleading communications
- Not manipulate, fabricate, or incentivize dishonest reviews in violation of applicable platform policies or laws
- Maintain appropriate privacy policies and disclosures on your store
- Not attempt to reverse-engineer, decompile, or otherwise access the source code of our Service
5. Intellectual Property
- Your content: You retain ownership of your store content and branding. Reviews submitted by your customers belong to you as the merchant.
- Our platform: The Reviewbird platform, including its software, design, and documentation, is owned by Reviewbird and protected by intellectual property laws. You may not copy, modify, or distribute our platform.
- Review content: Customer-submitted reviews are licensed to you for display on your store and marketing materials. You are responsible for ensuring your use of reviews complies with applicable laws.
6. Payment and Billing
- Billing is handled through your e-commerce platform (e.g., Shopify Billing) or through Stripe for direct accounts.
- Subscription fees are billed according to the plan you select. Plan details and pricing are available on our website.
- We reserve the right to change pricing with 30 days' notice.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our reasonable control.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim related to the Service shall not exceed the fees you paid in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- We are not responsible for the content of reviews submitted by end customers.
9. Termination
- By you: You may cancel your account at any time through your account settings or by contacting support.
- By us: We may suspend or terminate your account for violation of these Terms, with notice where practicable.
- Effect of termination: Upon termination, your data enters a 60-day soft-delete retention period. After this period, all data is permanently deleted. You may request a data export before the retention period expires.
10. Data Protection
Our collection and use of personal data is governed by our Privacy Policy and, where applicable, our Data Protection Agreement.
11. Indemnification
You agree to indemnify and hold harmless Reviewbird from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
12. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
